How Time Goes By......

Almost three years ago, the FDIC closed down the corrupt and ineptly managed bank First National Bank of Edinburg.

In the majority of cases the FDIC has indicted directors (guys like David Rogers, Robert Gandy and Michael McCarthy) of failed banks  where fraud has been alleged, the indictments are typically served just prior to the three year statute of limitations on the three year annivesary of shutting down the institution.

(Of course, if the FDIC really suspects there is fraud, they can get it little more time).  

So what will that mean as the Tundra Village Lawsuit proceeds???

  1. I'm curious, in your example you list three individuals, but not the fourth executive, the then CFO Saul Ortega, why?

    I don't know, I have no idea, but just coming here and reading these comments, I am now convinced, nothing of consequence is happening to anyone involved in this scandal.

    I wonder, if these guys were lucky because it appears the bank regulators themselves didn't know what they were doing in their supervision of the bank. Their (govt. regulators) ineptitude caused essentially four hemoroids to flare inside their (govt. regulators) ass, and now they are just hoping and waiting for the Preparation H to finally kick in and remove this pain in their ass once and for all.

    1. The initial statement is appropriate. Unlike the three listed, the regulators did not force Ortega out. The regulators almost always leave someone with senior level knowledge of the organization, since they certainly lack any.

      Yes, regulators definitely compound problems. FNB is a great example because it should have been closed years early to minimize the very substantial cost to the insurance fund.

  2. whatever happened to the lawsuit? i thought it was going to trial a long time ago? is is true the original attorney got sued? if there is a case against this bank, why doesn't someone go to trial with it? what's happening in court?

  3. Didn't a bunch of these guys get dismissed from the lawsuit? What's going on? Seems to me this blog doesn't talk about the lawsuit anymore. I mean, when is it going to go to trial?

  4. Eric Sherer was dismissed today. Rogers, Gandy, and McCarthy were dismissed too. Plaintiffs can't amend their pleadings either. What will happen to the people who have been working on this blog since 2009?

  5. sounds like this whole thing is falling apart. bet the new batch of lawyers bale out like the last ones. no money in this case. who owns the village now?

  11. how time goes by and by and no trial whatever happened to this case proceeding to trial doesn't seem ever going to trial aint it time for everyone to get new lawyers seems to happen every year or so and how come padillas partner still a plaintiff aint he the reason that bunch of lawyers had to quit a coupla years back hey now seems like something dont quite add up but i bet this post get deleted dontcha know
